Warranty conditions

1. warranty conditions
(1) The Institute for Water and Environmental Improvement Ing. Bernhard Ratheiser GmbH, Sonnrainweg 4/5, 9554 St. Urban (iF “Warrantor”) grants the warrantee (iF “Customer”) – in addition to and without limiting the statutory warranty claims and product liability provisions to which he is entitled against the Seller – a claim in accordance with the following warranty obligation for new goods. The definition of goods is that of the GTC of the guarantor in force.

2. temporal and spatial guarantee conditions
(1) The Institute for Water and Environmental Improvement Ing. Bernhard Ratheiser GmbH, Sonnrainweg 4/5, 9554 St. Urban grants a warranty period of five years on the products sold.

(2) The warranty period shall commence from the date of issue of the invoice.

(3) The territorial scope of these guarantee conditions extends to the member states of the European Union as well as Switzerland, Norway, Bosnia-Herzegovina, Serbia, Northern Macedonia, Montenegro, Albania, San Marino, Liechtenstein, Vatican City State, Andorra, Belarus, Moldova excluding Transnistria and Ukraine excluding the territories currently annexed by the Russian Federation.z, in separation and/or in civil war.

3. consumer
(1) The warranty conditions are only applicable to consumers as defined in § 1 of the Austrian Consumer Protection Act.

4. content and scope of the warranty
(1) Defects that limit the functionality of the product due to material or production defects are covered by these warranty provisions.

(2) Defects shall be remedied by the guarantor within a reasonable period of time free of charge by repairing the defective product.

5. warranty exclusions
(1) Defects or malfunctions caused by the following are not covered by warranty
⦁ Wear during normal use,
⦁ Improper installation by the buyer,
⦁ Failure to follow the maintenance instructions specified by the warranty provider,
⦁ External influences, e.g. transport damage, damage due to impact or
Impact, damage due to weather conditions or other natural phenomena,
⦁ failure to observe the safety precautions prescribed by the guarantor as well as
⦁ In case of unauthorized repair attempts by the customer.

6. procedure of the warranty check
(1) Claims for repair arise only if the guarantor is given the opportunity to examine the possible warranty case.

(2) The goods shall be delivered by the customer to the Institute for Water and Environmental Improvement Ing. Bernhard Ratheiser GmbH, Sonnrainweg 4/5, 9554 St. Urban. Any transport damage shall be attributable to the customer. The product must be accompanied by a copy of the invoice and a brief description of the defect.

(3) Without an attached copy of the invoice, the guarantor may refuse to process the warranty claim.

(4) In the event of a justified complaint that falls under these warranty conditions, the goods shall be sent free of charge. The guarantor will reimburse the postage costs for the outward shipment and the return shipment to the customer. In case of an unjustified claim, the guarantor will only replace the return shipment to the customer.

7. money back guarantee
(1) If the customer is not satisfied with the effectiveness of the purchased product, the guarantor will refund the purchase price.

(2) The money-back guarantee requires that the purchased product is free of defects in the sense of these warranty provisions.

(3) The money-back guarantee period starts from the invoice date and is valid for 5 months.

(4) The shipping costs shall be borne by the customer.

(5) Upon receipt of the returned product at the location of the Guarantor, the Guarantor shall transfer the purchase price to a bank account specified by the Customer within 14 days. The return must be accompanied by a copy of the invoice. The guarantor is entitled to refuse the money-back guarantee in the absence of a copy of the invoice.

8. other
(1) The place of performance of these warranty conditions is the company location of the guarantor.

(2) The exclusive place of jurisdiction for disputes arising from these warranty conditions shall be the court with subject-matter jurisdiction for the registered office of the guarantor in 9554 St. Urban, Austria.

(3) These warranty conditions shall be governed by Austrian law, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods as amended from time to time.
